ISO 45001 and Legislative Decree 81/2008: integrating the occupational health and safety management system with statutory requirements
ISO 45001:2018 and Legislative Decree 81/2008 do not overlap: the management system amplifies statutory obligations, reduces insurance claims and demonstrates adequacy where a Model 231 is in place. A practical integration map.
The point
Adopting an ISO 45001 system does not replace the obligations of Legislative Decree 81/2008; it organises them into processes that can be measured and verified. For the Italian courts, certification is a factor in assessing the adequacy of the Model 231 in accident-related matters.
What 45001 adds
- Systematic risk-based thinking (not the DVR alone).
- Leadership and top management commitment (clause 5).
- Structured worker consultation beyond the RLS (Workers’ Safety Representative).
- Annual internal audit of processes.
- Documented management review.
- Continual improvement measured with KPIs.
Operational integration
| Legislative Decree 81/2008 | Corresponding ISO 45001 requirement |
|---|---|
| DVR, Article 28 | Risk assessment, clause 6.1 |
| Periodic meeting, Article 35 | Management review, clause 9.3 |
| Training, Article 37 | Competence, clause 7.2 |
| Health surveillance, Article 41 | Monitoring, clause 9.1 |
| Incident procedure, Article 18 | Incident investigation, clause 10.2 |
Common mistakes
- Treating the system as “paperwork for the audit” rather than a living flow.
- Failing to link safety KPIs to company objectives.
- A superficial management review.
Forgest supports the company from the initial analysis through to certification, integrating ISO 9001 / 14001 where already in place in order to reduce the documentation overhead.
Related training: an effective ISO 45001 system assumes that the whole organisation is trained. The most relevant paths are the RSPP/ASPP Module A course for prevention and protection service managers and manager training to secure the top management involvement required by clause 5.
